What Is a Death Certificate — And the Chain It Triggers

A death certificate (मृत्यु प्रमाण पत्र, Mrityu Praman Patra) is the official record of the date and place of a person’s death. It does not state the cause: Section 17 of the RBD Act (as amended in 2023) bars disclosing the cause of death on any certificate issued, so the cause goes on a separate medical certificate, the MCCD (Form 4/4A, see below). The Registration of Births and Deaths Act, 1969 (amended in 2023) makes registering every death compulsory. India registered 89.38 lakh deaths in 2024, a 99.4% registration level, up from 48% in 2000 (CRS Report 2024).

What most people only realise when they need it: the death certificate isn’t the end of a process, it’s the start of one. Every financial, legal and administrative step after a death needs it first:

  • Insurance claims can’t start.
  • EPFO benefits can’t be released.
  • The bank won’t release the deceased’s accounts.
  • Property mutation on Bhulekh (Varasat) won’t begin.
  • Pension transfer through SSPY won’t be processed.
  • The ration card won’t be updated.

The RBD Amendment Act, 2023 also made specific changes: hospitals must issue a cause-of-death certificate, the Registrar must issue the death certificate within 7 days of registration, registration can be done digitally, the deceased’s Aadhaar details are collected where available, and special sub-registrars can be appointed during disasters or epidemics to register mass casualties.

The 21-Day Rule — Every Day of Delay Adds Complexity

1Within 21 days: free

Report to the local Registrar: the municipal office (urban) or Gram Panchayat (rural). Hospital deaths are often reported automatically through CRS. The certificate is issued within 7 days (RBD Amendment 2023). The only bracket that costs nothing and needs no extra paperwork.

222 to 30 days: late fee

The same process with a nominal late fee of ₹2-50. No extra documents.

331 days to 1 year: permission

The District Registrar’s written permission, a self-declaration explaining the delay, and the prescribed fee. The 2023 amendment allows self-attestation instead of a notarised affidavit here.

4After 1 year: magistrate's order

From the District Magistrate, SDM or Executive Magistrate, through a petition (usually via a lawyer) with evidence: hospital records, the cremation register entry, a newspaper obituary, witness affidavits. Weeks to months, plus legal costs.

Why delay hurts more for a death than a birth: insurers have their own claim deadlines (for LIC, usually within the period stated in the policy). EPFO must settle complete claims within 20 days (Para 72(7) of the EPF Scheme), and it has directed that death claims be settled within 7 days. Banks may freeze joint accounts as soon as they hear of a death informally, before any certificate. Disputes among heirs grow quickly if Varasat doesn’t start. Every day without the certificate is a day the family can’t reach the deceased’s money.

Documents Required — Hospital, Home and Unnatural Deaths

Hospital / Institutional Deaths

  • The hospital’s death report, Form 4 (MCCD): the main document. The attending doctor fills in this WHO-designed form with the date, time, medical cause of death and the doctor’s details. A government hospital’s report carries more weight. Ask for it before you leave the hospital, because it’s harder to get later. If the hospital refuses, complain to the district Chief Medical Officer (CMO).
  • The deceased’s Aadhaar or other government ID: a voter ID, PAN or passport if there’s no Aadhaar.
  • The applicant’s Aadhaar: the immediate family member registering the death. Their relationship to the deceased is checked during processing.
  • Cremation or burial certificate: from the shamshan ghat or kabristan authority. Not always mandatory but strongly recommended; it independently confirms the death and the last rites.

Home Deaths (Natural Causes)

  • A certificate from the Gram Pradhan (rural) or ward councillor (urban) confirming the death at home, with the date, the deceased’s name and address, on letterhead with signature and seal.
  • The deceased’s Aadhaar and the applicant’s Aadhaar.
  • Statements from two witnesses who were present or know of the death directly.
  • A doctor’s certificate, if available: if a doctor saw the person before or at the time of death, their certificate of the cause strengthens the application, especially for a delayed registration.

Unnatural, Accidental or Suspicious Deaths

A completely different process: the certificate can’t be issued until the police investigation is complete.

  1. FIR

Report the death at the local police station.

  2. Post-mortem

At a government hospital, where a forensic doctor determines the cause and manner of death.

  3. Police panchnama

The inquest report recording the circumstances.

  4. Police clearance

Confirmation that there’s no legal objection to issuing the certificate.

  5. Death certificate

Only now does the Registrar issue it. This takes days to weeks depending on the case; stay in touch with the investigating officer.

Three Portals — Same as the Birth Certificate

Situation Portal Address
Recent registration / hospital death CRS portal crsorgi.gov.in
Urban area (Nagar Nigam) e-Nagarsewa e-nagarsewaup.gov.in
Older records / all 75 districts eSathi (eDistrict portal) esathi.up.gov.in

The same three-portal system applies as for birth certificates. On eSathi: log in → “मृत्यु प्रमाण पत्र” → fill the form → upload documents → pay ₹10-15 → submit. The application goes to the local Registrar of Births and Deaths (the Gram Panchayat secretary in villages, the urban local body in towns), who issues the certificate; then download the digitally signed PDF.

The move to one portal: in 2020 the state decided to bring birth and death registration onto the single CRS portal (crsorgi.gov.in), as Patrika reported at the time. Gram Panchayat secretaries were trained as Registrars and given CRS logins, and urban local bodies also work as Registrars on CRS. The eSathi and e-Nagarsewa birth and death routes still appear on some district and municipal pages, so if one doesn’t work for you, ask your Gram Panchayat secretary or municipal office for the CRS route.

MCCD — Why “Cause of Death” Is a Separate Document

The Medical Certificate of Cause of Death (MCCD) is not the death certificate. It’s a separate medical document that records the medical cause in a WHO-standard chain: immediate cause → antecedent cause → underlying cause. The attending doctor fills in Form 4 (hospital deaths) or Form 4A (deaths outside institutions).

Coverage in India is low: only 23.4% of registered deaths were medically certified in 2021 (MCCD Report 2021, Registrar General of India).

Downstream Claims — What to Do After Getting the Certificate

This is where the death certificate connects to every other UP government system. Most guides stop at “apply for the certificate”; the family’s real journey starts here.

Property Mutation — Varasat on Bhulekh

When a landowner dies, the revenue records on UP Bhulekh (upbhulekh.gov.in) must be updated to show the new owner. This Varasat (inheritance mutation) needs:

  • the death certificate from eDistrict
  • the Parivar Register Nakal from the Gram Panchayat
  • a legal heir certificate from the Tehsildar or a court
  • the existing khatauni from Bhulekh

The Lekhpal checks the documents and confirms the heirs at village level, and, if no one disputes the succession, the Revenue Inspector records it (UP Revenue Code 2006, Section 33); the UP government’s target for undisputed mutations is 45 days. A disputed case goes to the Tehsildar under Section 35, who issues a proclamation inviting objections; the order can be appealed to the SDM within 30 days (Section 35(2)). The khatauni on Bhulekh then shows the heir(s). Without the death certificate, the Revenue Department won’t start Varasat, and the land stays in the deceased’s name indefinitely.

Insurance Claims — LIC and Private Insurers

For LIC, submit Claim Form A (Form 3783, the claimant’s statement), the original policy bond, the death certificate, the claimant’s bank NEFT details and ID proof. If the death occurred within 3 years of the policy starting, LIC also asks for Form 3784 (Claim Form B, from the doctor who attended the last illness), Form 3816 (Claim Form B1, if the insured was treated in hospital), Form 3785 (a certificate of identity and burial or cremation) and Form 3787 (the employer’s certificate, for working policyholders). Under the IRDAI Master Circular on Protection of Policyholders’ Interests (September 2024), insurers must settle a death claim within 15 days if no investigation is needed, or within 45 days if it is.

If the policy has an accidental-death rider, the insurer needs the specific medical cause of death, which the Registrar’s certificate does not contain; it is on the MCCD (Form 4). Get Form 4 from the hospital separately: the death certificate and the medical certificate of cause of death are different documents for different claim requirements.

EPFO — Three Separate Benefits Most Families Don’t Know

When an EPF member dies, the family is entitled to three different payouts, each through its own form, and all need the death certificate.

20PF balance (Form 20)

The accumulated provident fund, paid as a lump sum to the nominee or legal heir.

10DEPS pension (Form 10D)

A monthly pension under the Employees’ Pension Scheme for the surviving spouse, children or orphans.

5IFEDLI insurance (Form 5IF)

A lump sum of up to ₹7 lakh under Employees’ Deposit Linked Insurance. It’s automatic for every EPF member with no separate premium, and many families don’t know it exists; for a family that has lost its main earner it can be life-changing.

All three need the death certificate, the UAN, Aadhaar and bank proof. If no nominee was registered, a succession certificate or legal heir certificate is also needed. Para 72(7) of the EPF Scheme sets 20 days for settling a complete claim, and EPFO has directed that death claims be settled within 7 days.

Bank Account Succession

  • Nominee registered: death certificate + nominee’s ID + the bank’s claim form, and the nominee receives the balance.
  • No nominee: death certificate + a succession certificate (civil court) or legal heir certificate (Tehsildar). Under the RBI (Settlement of Claims in respect of Deceased Customers of Banks) Directions, 2025, claims up to ₹15 lakh (commercial banks) or ₹5 lakh (co-operative banks) are settled through a simplified procedure, with an indemnity bond and affidavit instead of a succession certificate.
  • Locker: death certificate + the claimant’s KYC + proof of heirship; the locker is opened in front of bank officials and witnesses and an inventory is made.

Pension Transfer

  • Government pension: the surviving spouse or eligible dependant gets the family pension. Central government families apply under the CCS (Pension) Rules 2021 with the death certificate and Form 10 (to the Head of Office) or Form 12 (the spouse’s claim to the pension disbursing authority); Form 14 belonged to the old 1972 Rules. UP state government pensioners’ families use the UP treasury/pension department forms.
  • EPFO: Form 10D, as above.
  • NPS: death certificate + PRAN details + the nominee’s declaration to the NPS nodal office.

Ration Card, Voter List and Aadhaar

  • Ration card: give the death certificate to the Food & Civil Supplies Department; the name is removed, and the family’s category (APL/BPL/AAY) and monthly allocation may change.
  • Voter list: give the death certificate to the Booth Level Officer (BLO) or the Election Commission to remove the name from the electoral roll.
  • Aadhaar: once you have the death certificate, report the death on the myAadhaar portal (“Reporting of death of a family member”) with the deceased’s Aadhaar number and the death registration number. UIDAI validates the details and then deactivates the Aadhaar, so it can’t be misused; it had deactivated more than 2 crore Aadhaar numbers of deceased people by November 2025. You can also write to the UIDAI regional office with the death certificate.

UP Scholarship Impact

If the deceased was the earning parent whose income certificate was used for a child’s UP Scholarship application, the application may need updating: the child may now fall in a different income bracket, or need a fresh income certificate showing the family’s income after the parent’s death.

What to Do First — 5-Step Sequence for Families

  1. Day 1: the primary death document

Form 4 (hospital death report) for a hospital death, a Gram Pradhan certificate for a death at home, or an FIR for an unnatural death.

  2. Day 1-2: cremation or burial certificate

From the shamshan ghat or kabristan authority.

  3. Day 1-21: register the death

At the local Registrar: the municipal office or Gram Panchayat. Within 21 days it’s free.

  4. Day 7-30: get the death certificate

Within 7 days from the local Registrar (RBD Amendment 2023). On the eSathi route it typically takes 7-15 working days, and the certificate is still issued by the Registrar. Get 5-10 certified copies.

  5. Day 30 onwards: start the claims

Insurance, EPFO (all three forms), bank succession, Varasat on Bhulekh, pension transfer and the ration card update.

Common Rejection Reasons — 6 Problems and Fixes

1Date of death doesn't match

The hospital report and the application form differ by even one day, and it’s rejected. Copy the exact date from the hospital document.

2Relationship not proved

The applicant must be immediate family. Upload proof: a ration card showing both names, the Parivar Register Nakal, a marriage certificate or the applicant’s birth certificate.

3Late registration without permission

Each delay bracket needs its own permission. Applying without the right one means automatic rejection.

4Home death without the Gram Pradhan's certificate

Without an independent local confirmation, the Registrar has nothing to verify against.

5Self-declaration unsigned or wrong format

The self-declaration form must be signed and uploaded as a JPEG under 100KB, as for every eDistrict certificate.

6Blurry scans

Scan in black and white at 200 DPI, and check it’s still readable after compressing to under 100KB.

How Many Copies to Get — And Why 5 Is Not Enough

Every institution wants its own copy, and none accepts a photocopy: banks, insurers, EPFO, the sub-registrar (property), pension offices and ration card offices each want a certified copy or a printout of the digitally signed PDF.

The eSathi digitally signed PDF can be downloaded any number of times, and every printout is equally valid, because the QR code and digital signature can be checked at edistrict.up.gov.in → “प्रमाण पत्र का सत्यापन”. It’s also available in DigiLocker (digilocker.gov.in).

Frequently asked questions

What is a death certificate in UP?

An official document (मृत्यु प्रमाण पत्र) recording the date and place of a death, issued by the Registrar of Births and Deaths under the RBD Act, 1969 (amended in 2023). Three portals are involved: CRS (crsorgi.gov.in), e-Nagarsewa for urban areas, and eSathi for older records. Since 2020 UP has been moving birth and death registration onto the single CRS portal, where Gram Panchayat secretaries and urban local bodies work as Registrars. India registered 89.38 lakh deaths in 2024, a 99.4% registration level. It does not state the cause of death: Section 17 of the RBD Act (as amended in 2023) bars disclosing the cause on any certificate issued. The cause is recorded separately on the MCCD (Form 4/4A).

How soon should I register a death?

Within 21 days, free. After that: 22-30 days with a late fee, 31 days to 1 year with the District Registrar's permission, and after 1 year with a magistrate's order (over 2 years, a Judicial Magistrate's order once the 2026 amendment is in force). Insurance and pension deadlines make it more urgent still.

What happens with unnatural deaths?

FIR, then post-mortem, then the police panchnama (inquest report), then police clearance, and only then the certificate. It can't be issued while the investigation is pending, which takes days to weeks.

What is the MCCD, and do I need it separately?

The Medical Certificate of Cause of Death (Form 4, or 4A for deaths outside institutions), filled in by the attending doctor, records why the person died. The death certificate confirms that the death happened and never states the cause (Section 17 of the RBD Act bars it). The hospital must give the MCCD to the Registrar and, free of charge, to the nearest relative. Only 23.4% of registered deaths in India are medically certified (MCCD Report 2021). For an accidental death rider or a disputed cause, get your copy of Form 4 from the hospital.

What is EPFO EDLI, the ₹7 lakh insurance?

Employees' Deposit Linked Insurance: automatic for all EPF members, with no separate premium. Up to ₹7 lakh is paid as a lump sum to the nominee through Form 5IF. Many families don't know it exists. It needs the death certificate, the UAN and the nominee's details.

How is the death certificate connected to Bhulekh?

Property mutation (Varasat) on UP Bhulekh needs the death certificate as the first document. The Lekhpal verifies the heirs and, if no one disputes the succession, the Revenue Inspector records it (UP Revenue Code 2006, Section 33); the UP government's target for undisputed mutations is 45 days. A disputed case goes to the Tehsildar (Section 35), who issues a proclamation inviting objections, and the order can be appealed to the SDM within 30 days. Then the khatauni updates. Without the death certificate, the land stays in the deceased's name.

How many copies should I get?

At least 10. EPFO needs 3 (separate forms for PF, pension and EDLI), and insurance, the bank, the sub-registrar, the pension office, the ration card office and the voter list need one each, plus spares. eSathi lets you download the digitally signed PDF as often as you like.

Can I apply from another state?

The death is registered where it happened: for a death in a UP hospital, by that area's Registrar. Copies can later be downloaded from eSathi from anywhere, and the digitally signed PDF is valid across India under the IT Act, 2000.

How do I report the death to Aadhaar?

Once you have the death certificate, a family member can use the "Reporting of death of a family member" service on the myAadhaar portal, giving the deceased's Aadhaar number and the death registration number. UIDAI validates the details and then deactivates the Aadhaar; it had deactivated more than 2 crore Aadhaar numbers of deceased people by November 2025.
